Legal Question in Personal Injury in Missouri

I just recently wrecked my car and the insurance co is totalling the car. They are also trying to tell me damages to my car prior to the wreck is a ridiculous amount. However i researched to replace and fix theses items and it is no where near wha they are saying. They are also trying to tell me that my car is not worth as much as it sells for fair condition private party kelly blue book value.The car is a 2005 Mazda 6 and only has 68xxx miles on it. I also researched how much that particular vehicle is going for and they arent even willing to give me what it wouls sell for at an auction... The damages that they are subtracting are the bumper due to a cut, the engine having normal dirt under it (mind you i just had the car detailed the ay of my wreck) hail damage that happened when it was in their possession, A small tear in the driver seat, the headliner. I hit the back of a truck with the front of the car and they are saying the winshield is pitted however the hood went into the winshield at the wreck. Is this even worth trying to fight or would i just waste time?

The question as to whether it is worth fighting an insurer, is specific to the facts of each case. Find out how the specific facts of your case determine yoru next best step. It matters whether it is your insurer or the insurer of the other driver. If damage occurred while it was in their control (as you described the hail damage) than that should not diminish the value at all. If you have found comparables in your area, than that should bolster your figures or theirs. Tell them you will nto accept less thatn is fair and may need to consult with legal counsel.
