Legal Question in Wills and Trusts in Missouri

My Dad is remarrying after Mom passed 5 years ago. What questions should I ask and what should be addressed to his new wife to be before my 78 year old Dad remarries?

You should, in a respectful manner, ask your father if he has considered a prenuptial agreement to ensure that whatever he plans to leave for his new wife is respected by her. If he is concerned about providing something for her, it is very easy to have a portion of his assets held in trust for her benefit for a period of time, but ensuring those assets pass to his children after that period of time expires. He really needs to see an attorney and discuss all the options. It is very likely that she has children too that she will want to protect should she die first. It is the right thing to do.
