Executer of estate

My mother named my sister as executer of her estate. My mother's estate is in probate. My sister says my mohther's expenses ate up every penney of her bank accounts, CD's & stocks. I know that there is money left which my sister is keeping for herself. How can I hold my sister accountable & have the funds distributed between all 4 of us children?

I believe that you should hire an attorney to represent you in the Probate proceedings. The attorney could file appropriate pleadings and obtain a Court Order, if necessary, requiring your sister to provide a full accounting for any and all assets, income and expense. The attorney would take whatever legal steps were necessary to protect your legal rights and assure that a fair and legal distribution of the proceeds from the probate estate is made without undue delay. I do not believe that the same attorney could represent you and other siblings since there is an excellent possibility of a conflict of interest if he or she does so.
