Employment/Termination of position

In July 2008, I was laid off from my position as an Admissions Coordinator. I was told it was based on budget/fiscal reasons and ensured it was not based on job performance. Within a few months of being laid off, I discovered that the position I had been released from, had been filled. This position was not posted for applicants but instead filled with someone they had chosen from within the organization. My question(s) are: Did they have any legal obligation to offer me this position once it was again opened? Should this position have remained closed and unfilled for any period of time before opening it once again?

You may have a wrongful termination case. Who is the employer? Did they hire the new person under a new budget?
