Legal Question in Employment Law in Montana

Labor question

My question is can a person be giving a written warning for off duty msconduct.

The misconduct was putting grease on the door handle of a van for a joke. The owner of the van was met through work.

Re: Labor question

As a general rule, you cannot be cited for things you do while not in the course of working, even if the person was met through work. However, if your employment contract has some sort of clause that requires you to behave even while off duty (a morality clause), you may be open to being cited.
