Re: bb gun

Any number of charges may be brought at the discretion of the prosecutor. The fact that it was a bb gun is unimportant if the average person might mistake it for a real gun; you would be charged as though it were a real gun. Two likely charges are assault and use of a weapon to make terroristic threats. Waving the gun around is not less threatening than pointing it directly at someone. The charges are unlikely to be any different than if the subject went into the store with a loaded shotgun and pointed it directly in someone's face.
