Expungement

I actually have two part question

I was convicted of Attempt of Robbery and Felony theft when I was 16 in Cass county. I have two felonies for one crime. I was charged adult and I was curious I remember it was 361 dollars I believe that I took. Should I have TWO Felonies, I mean can they convict you twice for the same thing? I just found this out that I have two felonies listed. I don't remember pleading guilty to felony theft.

So like I said I was 16 when it happened 17 when convicted I received 2.5 years probation. Will I have to expunge both of these offenses separately even though it is the same offense or it happened during the same crime? What are my chances of having it expunged? Are there certain things I should do to make it easier. I am 27 now and have recently had a 1st offense DUI? Would that affect my chances of expunging something I feel I should have been charged juvenile for. I have absolutely nothing on my juvenile record at all! I never had a juvenile record and I just got mixed up with the wrong crowd. Any help would be greatly appreciated!

It is possible to charge two crimes out of the same set of circumstances. Whether or not it is proper in any particular situation is something your attorney should decide. In any event, you now have the two convictions. You can move for a set aside or pardon for both offenses at the same time. I would recommend going for the set aside first, as it is easier. The DUI certainly doesn't help. However, if you have an attorney help you he or she can work to minimize the impact of that.
