Legal Question in Family Law in Nebraska

Adoption or guardianship

I have an 8 year old daughter who was with her father who was on social security and I paid child support; he recently passed away and directed thru will to put her with friends as ''guardians''. Will I continue to have to pay child support to the guardians? I am working and have always paid support but am struggling financially and would be relieved to have my dauther and the extra $400 per month - but the family in that community wants her to stay there and I kinda wouldnt mind that either. What to do?

Re: Adoption or guardianship

Child support is not for the father. It is for the child. You will continue to pay as long as she is a minor and you do not have custody. However, since the guardians' income probably differs from the father's, you can request a modification of the amount you pay. Make sure, though, first that you won't end up paying more - it only helps if it lowers your obligation. An attorney can assist you in determining what the result of a modification would be.
