New Dad Adoption

I have a 5 year old son who has lived with me from day one. His biological father has not seen him since he was 3 wks old, nor have I heard from him. My boyfriend of 4 1/2 years would like to adopt him (my son only knows him as daddy). The absent sperm donor does pay child support through the county, but it has never been too consistent. Where can I go from here to get my son adopted and his last name changed? There has never been any court orders other then the child support.

P.S

My son was born in CA, and that's where the child support order is (San Bernardino Co.), but we currently live in NE.

If the father is paying child support, it will be very difficult to terminate his rights without father's consent. However, if father truly has no interest in child, he may be willing to relinquish custody because it will end his obligation to pay. Try to go that route with him.
