Legal Question in Traffic Law in Nebraska

driving my friends car 2

I was driving my drunk friend home and accidentally rear ended someone in his car. He only has liability coverage that will not pay for his car, just the other guys. I have given him $450 to help fix the car, now he wants to sue me for more. He willingly gave me the keys, and told me to drive home. Does he have a case?

Re: driving my friends car 2

Yes, he has a case. When you accepted the keys to drive him home you assumed the duty to do so in a safe and reasonable manner. You breached that duty by rearending another car. You also received a citation for the accident. All he has left to prove is the amount of damages to his car. Why would you think he doesn't have a case? The fact that you were providing a free service to a friend doesn't matter at all. Once you agreed to perform the service you were obligated to do it with due care and caution. Apparently, you don't have auto insurance. If your friend didn't have liability insurance, you would be responsible for the damage to the other car as well.
