IRS Debt

My Divorce Decree indicates that my ex-husband is responsible for all tax debt, interest and charges accumulated during the marriage. However, each year, the IRS is keeping my refund and sending me a notice that because of the debt with his SSN#, it will be applied to that. My ex has not made any attempt to pay the IRS or to reimburse me for the refunds I have lost. Would the Decree hold up in court if I tried to sue him for reimbursement of these funds? And should I pursue this with a Divorce Lawyer or Small Claims Court?

If your Decree states that your former spouse is responsible for all tax debt accumulated during the marriage then your recourse is to file a motion in Family Court.
