No Marriage Certificate...do I need a divorce?

I was married in 1999 in San Bernardino County, CA. Our marriage certificate was never filed. I changed my name on my license and SS.

I haven't lived with my husband for 1 year and I moved to Nevada with our daughter in April.

Do I need to file for divorce if there is no record of marriage?

Can I leave Nevada with my daughter if there is no divorce?

Marriage does not make a difference on the issue of moving out of state with the child. You need to obtain the father's consent or have a court order. Since you have a putative marriage and need to decide custody and visitation and the move, I suggest that you file for divorce and/or custody.
