Legal Question in Family Law in Nevada

Mother needs to leave the state with son, unmarried parents

I was not married to my sons father and have lived in Nevada for 5 years My sons father moved to another Nevada city and sees his son whenever its convenient. I need to move out of state for financial/family reasons. What are the chances that a Judge will allow this move?

Re: Mother needs to leave the state with son, unmarried parents

First you have to show the court that there is a good faith reason for your move, ie. better job offer, family in the state where you are moving etc. and that the move is not designed to thwart the father's contact with the child. If the court is convinced that you have a good faith reason for the move then the court is supposed to give the father comparable visitation to what he has now. If the father's contact has been sporadic then it won't be hard to give him comparable visitation. For example, with a school age child, the court would be looking at the long holidays and considerable time during the summer. If he is paying you child support and he will incur additional expense for transporting the child, the court can reduce his child support obligation to reimburse him for some or all of the expense he will be incurring in transporting the child.
