selling at home not married

I live with my ex-husband and we bought a home together after our divorce. Both names on loan but I want to sell and he does not want to sell. What do I do?

You really don't have a family law question since everything happened after your divorce. You probably own the property as tenants in common or joint tenants. Your remedy is to file an action in partition assuming you cannot agree on how to use the property. The court might then order the sale of the property if you still cannot reach any other agreement.

You will have to sue him for what is called a partition action. The judge could order him to sell if he cannot buy you out and refinance. Is there enough equity to make this worthwhile.
