Hit on the hand by manager at work

I was just recently hit on the hand by a manager at my work.

The reason he did this was for me accidentally emailing his father and not him .His father has the same name and is an officer in the company. He stood in front of me and asked me--name removed--hold out my hand, not thinking he was going--name removed--hit it. I held out my hand and he slapped it and told me not--name removed--do it again (emailing his father) in an �I�m the boss tone�. There were also customers in front of us. There was one employee who heard him. I immediately informed my immediate supervisor and was advised--name removed--immediately--name removed--file a report with HR. I am very upset and want--name removed--know if I can pursue this out of the company. I have been with the company for over three years and have been a exceptional employee with numerous award and outstanding reviews.

If anyone hits you without your consent it is a battery, which gives rise (at least in theory) to both criminal charges and a civil lawsuit as well. I doubt the district attorney or police would be interested if you filed a criminal charge, but you could. You could also sue for battery, although I do not know if a Court would award you any significant damages. This is not the kind of situation I can assist with. As to your employment rights, you do not state if you are a union member, if you have an employment contract, or if this incident was the result of some sort of illegal discrimination (sex/race/religion etc.) all of which could influence your situation.
