End of lease release or bullying the young & helpless.

My son 20 signed a 6 month apartment lease. One month before the end of the lease he told them he would be leaving. At the end of the lease he returned his key and asked for his $400 deposit. They told him he had to give them a 1 month in writing notice even though the lease was up. They kept his deposit and wanted more money to equal an additional months rent even though he no longer lives there. What can he do????? Is this legal???? I think they are just taking advantage of a young person.

First of all, he is above 18 and an adult in the eyes of the law. He is bound to his lease term for six months. Therefore, if he left early, he would generally be responsible for any rent not paid. Here, he would be liable for the last month. One month notice would not have mattered since the term was 6 months.

You are correct in supposing that it is not necessary to give notice to terminate a lease for a fixed term at the end of that term UNLESS there is clear language in the lease to the contrary, such as an "automatic renewal" provision (which is not the same as a "holding over" provision which could also be in the lease).
