Legal Question in Bankruptcy in New Hampshire

Will the bank call the mortgage?

I own a home with a brother. He is the only person on the note, but I signed the mortgage and am on the deed. If I were to file chapter 7, would the bank be able to create difficulties for him? I ask because they had us sign a document saying that we did not see our individual financial pictures changing in the next six months. My financial picture has not changed. It was lousy then which is why I did not take part in the loan application process.

Re: Will the bank call the mortgage?

If your brother signed the note, then he is liable on it if you file bankruptcy. The bank is unlikely to call the note if payments are being made. I have a good deal of information on bankruptcy on my web site, www.fiorentinilaw.com
