My friend has a verbal contract with a partener in construction. He gives the money and the partner does the construction. He just found out that the partner was stealing most of the money. Two of the homes are in the partners name and one in my friends. My friend is out of money. Can he get the other two homes because he gave the money to buy them? He has a paper trail for this. He is a million dollors in dedt.

The short answer is probably. In addition to a good paper trail, an excellent attorney would be invaluable. Take legal action without delay.

A more detailed analysis of the facts would be required. He may be able to place a lien on the properties in order to protect his legal options. Without a written agreement it often ends up as "he said....", with the response "no, the other guy is wrong!"

The key will be the ability to prove the movement of the funds and the application of the money.

I suggest that meeting with an attorney would be the first step to addressing these issues.
