Legal Question in Family Law in New Hampshire

child custody

My question is If someone has tempory custody of a child and is suppose to do visits with the parents but cancels every other time its the fathers turn, is that right. It has happened more than twice.

Generally this is not acceptable. Naturally, the court will allow for the fact that some missed visits are unavoidable due to illness, weather, etc.. If the custodial parent is intentionally preventing the visits from happening that parent is probably in contempt of court. The soultion is to file a motion for contempt asking to make up the missed vists and some sort of order that makes it clear to the custodial parent that to continueing to skip the visits will lead to some sort of penalty. Be sure to ask for attorney's fees in any motion for contmept. In extreme cases it is possible that the interference with the visitation can lead to a change in custody.
