Legal Question in Real Estate Law in New Hampshire

placing liens and judgements

I would like to know the process for placing a lien and getting a judgement on a home for reinbursement of money paid out to sustain a mother and 3 children because the father would not pay their support as he had lost his job.....now he has a job and is still not paying support...I am paying for her support in lieu of his neglect,,,they own a home jointly. The amount I have expended so far is 20,000.00 Any guidance would be appreciated..I have not been able to find out much about liens and judgements..guidance there would also be appreciated..Thanks

Re: placing liens and judgements

You must file a lawsuit before you can get a lien. You can ask for a prejudgment attachment on the house but you will have to prove to a judge that you are likely to prevail on the merits in the lawsuit and that the defendant does not have sufficient other assets to pay you.

If you do not get the prejudgement attachment, you can try to win in court and if you get a judgment you can then attach the home.

It is a complicated matter and you should definitely get an attorney.
