Legal Question in Wills and Trusts in New Hampshire

death of an ex spouse

My ex-husband was ordered as part of our divorce decree to pay off 2 of ''my'' credit cards; as well as to have my name removed from the mortgage of the marital homestead. Before he did any of this he passed away.I have no idea if his siblings have opened a case @ probate. There was an insurance policy of which my eldest daughter was named beneficiary. It has already been paid to her. I am left with a mess on my credit. Credit cards in default, a mortgage that was foreclosed on and I don't seem to have any recourse other than to file for bankruptcy. Is there anything that can be done thru Probate to resolve these issues ie calling back the insurance policy?

Re: death of an ex spouse

The claims against your EX are a liability of his estate and you should notify the Probate Court and the Executor of these claims. Impossible to tell the results with so little information.
