Legal Question in Wills and Trusts in New Hampshire

Our father passed away in AZ on 10/31/09. In recent years we have not had a close relationship because his wife of nearly 40 yrs, not our mother, would make it difficult to see him when they were here in NH as well as when they wintered in AZ. We know that a few years ago, our dad inherited a large amount of money from a cousin who passed away leaving no other heirs. We want to know if we could possibly have a claim on that inheritance since we are blood relatives to that man while she is not. We also feel that if dad had a current will, it was prepared and signed under her control, not of his own free will. Do we need a copy of his will, if one exists? Do we need a copy of his cousin's will? We have heard that the widow is nervous that we might contest anything which leads us to believe that there is loophole she is aware of. Any advice?

Assuming your father was a resident of Arizona, you'll need to work with an attorney licensed in that state. In general terms, you father has the right to do what he wishes with the money he inherited. He may or may not have prepared a will. You need to check with the court in the area where he lived to see if a will was presented to the court. Given the passage of time, the ability to challenge a will may be somewhat difficult. The only way to determine your rights is to hire local counsel to examine the records and advise you.
