bad partnership

found out partner was stealing, wnet to court and the judge ordered us to mediation, during this it was agreed he would buy me out, after three months he decided this was not happening, we agreed for me to buy him out, after two weeks he decided this was not happening. now the business is going be lost for past taxes...., due to his negligence and delay i am going to lose eveything, what am i going to do? can the judge hold him liable for the lose of the business? can the judge order him to forfiet his shares in the business?
