steps to no longer be affiliated to an institution

I would like to know what to do if we want to become an independent church and no longer be part of the big institution we belongs to. we heard they're going to suit all pastors that changed the name of their church, replaced them by another pastor or take their property away (meaning the church building). sorry, if i choose the wrong law category but i didnt know where would it fall.

I have helped set up the legal framework for two separate small independent churches in this area (Paterson), and helped them in dealings with landlords, the City and other matters.

Splitting off from the main church has to be done carefully. You need to investigate who owns the building, what the church's charter and bylaws say, what the main church's legal documents say.

No attorney can just tell you how to do it. The attorney needs more information. You need to hire an attorney and get some expert advice.

Before doing anything, the Church's charter and any other related documents need to be reviewed. If there is real estate owned by the Church, the Deed needs to be reviewed to see who holds title. Then decisions can be made about "breaking off" from the main Church. You should see an attorney as soon as possible. If I can be of further help, please call my office for an appointment.
