Legal Question in Business Law in New Jersey

UCC claim on business

I have a UCC claim on a business and its assets. The business has been sold, and will be reopening soon without the claim being satisfied. Can the business open without satisfaction of the claim, and what are my avenues of recourse?

Re: UCC claim on business

What you describe is not supposed to happen. You need to take all your paperwork and go talk to a lawyer.

If it was done right, you now have the right to (a lien on) the items that were subject to the UCC filing. If it was done right. You could take and sell the items in order to pay the money owed to you. The person who bought and paid for those items will be highly angry.

Go see a lawyer who handles commercial litigation a lot. Bring ALL paperwork having anything to do with this deal to the attorney.

If you would like, give me a call; I am in northern New Jersey. I will be happy to discuss this with you; the telephone consultation will be free.
