Legal Question in Technology Law in New Jersey

We paid a software developer a large sum of money to developer an ASP.NET web application for us a few years ago and since then we have lost the source code that is needed to make any significant changes to our site. After requesting our source code from the developer, they are demanding that we pay $2000 for code that we already own. Is this legal?
