Bathroom Remodeling gone wrong

my husband and i hired a general contractor to remodel our bathroom. he isn't even close to being done with the bathroom, going on 4th month. the electrician couldn't finish his work nor the plumber (sub-contractors) we have givenn him 75 percent of the money and he hasn't returned our phone calls. can i sue him for the money that i gave him? also when we had the inspection for electric work (passed), he wanted to change the location on the outlets and asked the electrician to lie to me that it was okay. the electician came and informed me that is what he said. can i fire him and make him pay for a new contractor to complete the work?

A common problem that courts have with the situation that you describe is deciding who breached the contract. The facts seem clear to you but they will have to be proved in court. So, keep good notes of what is going on and what went on. Also, write to the contractor and tell him exactly what has to be done to complete the job and when you want it done. Take the opportunity to list all those things that have to be fixed. If you need some help, consult with a lawyer. If done correctly, this will place you on the high ground when and if you need to go to court.

If you have to throw the contractor off the job (as you probably will), ask your lawyer about how best to lock in your claim for damages. It is easy to wind up in a situation where the existence of damages can be proved, but not how much. In that event, the court can't speculate and will award you nothing by way of compensation.
