Legal Question in Construction Law in New Jersey

union

my husband works for a company and half of the workers have union and another half does not like my husbund. he does not get paid overtime or paid vcation or holidays nor does he have insurance. my question is if the company has some in union and does not have others is that allowed? my husband works on the same job sites funded by the gov. like schools firehouses ect.
