Legal Question in Consumer Law in New Jersey

very frustrated,

Phone calls are fine, but ALWAYS PUT IT IN WRITING. Send a letter to them, explain the problem briefly, and send a copy of your contract with it. Now, what do you want? Do you want out or just enforcement of your original deal? If you want to enforce the deal, tell them you will be happy to send them the payments required by the contract only, and if htey have a problem with that, and they report it to any credit reporting agency, they will be sued for defamation of credit. OR, you can tell them you will put the payments due in escrow (open an escrow acct at your bank) and you will send payment to them, as soon as they send you in writing, that they were in error, and your original contract will be enforced as written, and send them no more payments until they correct their records. OR, if you want to cancel, tell them they have materially breached their contract, so the contract is terminated. If they give you any more difficulty, report them to NJ Div. of Consumer Affairs, and if that does not do it, you have to go to an attorney.
