Legal Question in Credit and Debt Law in New Jersey

I recently lost my job. I had some medical debt- about 800.00 - that I had been paying on while employed. I contacted this particular debt collection agency and explained my financial situation. I was told I would have to give them specific documentation proving my inability to pay. They requested W2's for the last 2 years, 1040 for the last 2 years, pay stubs from the date of the emergency medical services provided and my Charity Care documents from the hospital where the care took place.

I have no problem with the pay stubs for the date of service and the Charity Care awarded by the hospital -but do they have the right to ask me for the tax documents? This seems like a major invasion of privacy.

None of that is relevant to your situation and I would not advise you to provide that information. In my opinion, they are fishing to find other assets. Unless you have a court order that says to provide the information, don't do it. /p/ See also: http://info.corbettlaw.net/lawguru.htm
