Legal Question in Credit and Debt Law in New Jersey

Within the last week, Experian has generated an extremely negative credit report for me which has resulted in at least one of my credit card accounts IAmex) significantly reduced with its credit line. When I contacted Experian about this matter, I discovered that they have mixed my excellent credit history with that of another individual who is severely delinquent in payments and is carrying several mortgages. What is really infuriating about this is that this other individual has a name that looks somewhat similar to mine, lives about 10 miles from me, and has a street number that is the same as mine (but completely different streets/towns). Moreover, our SS#'s are different and he is married while I have never been married. But somehow this was enough for Experian to conclude that we had to be the same person and in the process Experian is ruining my credit status. They apologized to me and promised to rectify the problem within 5 days, but my question to the legal community is - should I sue Experian for their incompetence? Both Transunion and Equifax have excellent reports for me but there should be some penalty for a company like Experian to operate like this without impunity.

Please advise.
