Legal Question in Credit and Debt Law in New Jersey

my wife just received an information subpoena from a law office. She would like to contact them and work out a payment (minimal of course) times are lean right now. They would like her to fill out a lot of paper work right now and threatened to ask for a warrent for contempt. If what she can pay a month is not acceptable to them what can they do? Thanks Tony B

The law firm may be willing to work out a payment plan but that does not change the requirement to complete the information subpoena. If your wife does not complete and return the subpoena, the creditor can have her arrested and jailed until she does. If she does work out a payment plan, be sure that it is in writing and that it includes a promise by the creditor to refrain from other collection efforts so long as she is current. � See also: http://info.corbettlaw.net/lawguru.htm
