Legal Question in Criminal Law in New Jersey

AggravatedAssault

I need to know about an Aggravated Assault charge. It was in self defense. If I plead guilty which I am not. How much am I looking at? In fines, I have no priors on anything, This woman attacked me in the apartment I was living in, I had 3 original charges of assault with a deadly weapon, aggrivated assault I don't remember the last one. Now they are sending me back to municipal court, with one charge of Aggravated asssault. I appreciate any thing you might have to share.MB

Re: AggravatedAssault

If your case is being sent back down to the municipal court that means that the prosecutor amended it to a charge of Simple Assault. This carries potential penalties of $1,000 in fines and up to 6 months in jail. If you did not assault anyone then you should never plead guilty to assault. Your choice is to take the case to trial. I would not recommend that you attempt to go to trial on your own - you should hire a lawyer to represent you. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.

Re: AggravatedAssault

If it got sent back to MC, you are looking at a max of 6 months. In order to tell you what you may actually get, I would need to know more about the case. I strongly suggest you get an attorney for this as you will have a criminal record if convicted.

My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
