Legal Question in Criminal Law in New Jersey

sex tape blackmail?

I have an exboyfriend that is threatening to make a sex tape we made 2-3 years ago public if I do not agree to meet up with him. I am 21 and I would like to do whatever it takes to avoid this from happening. Is this blackmail? I do not want to meet up with him to get the tape back, because now I'm scared. What can I do?

Re: sex tape blackmail?

A lot depends on the state where this is occurring. I would recommend that you retain an attorney in that state whether it be New York or New Jersey. You will likely have some civil claims against your ex-boyfriend and depending upon the facts there may be even a criminal element, although I would need more information in order to give you a full assessment of your rights. It may also be possible to obtain an injunction (court order) against your ex-boyfriend to prevent him from releasing this tape. In a situation like this it is essential that you act fast to prevent the release of the tape. If we can be of any assistance please feel free to contact my office.
