Legal Question in Criminal Law in New Jersey

abuse and harassment

3 years ago my daughter was dating this person. they were both drug users together. this man she was dating one night smashed her across the face with a lamp resulting in severe injury to her and she almost bled to death. At the time she did not admit or press charges against this man for doing that to her. We tried to get it out of her that this injury as serious as it was to almost take her life was not a result of a simple fall into a table, but she would not admit it so charges were never brought up on him. A short time after her injury my daughter did break up with this man. This man until this very day since then has been harassing and threatening my daughter. He not only is harassing her but he is harassing me and my family too now. He calls here saying all this untrue and wacked out crazy stuff about my daughter and now my family. It happens at anytime and all times of the day or night. He has been repeatedly told to stop. We had even gone to the police to file a report against him once but the police at the time did not have an address on him that the court order could be delivered too. Can I myself take legal action on him for all he has done? My daughter has admitted not too long ago that he did hit her that night.

Re: abuse and harassment

You can file either a private criminal complaint (or its equivalent in NJ) or file a motion for a protective order (also known as a PFA). Feel free to call our offices; we handle cases like this.

Re: abuse and harassment

This is really a police matter. What you are describing is a classic case of illegal harrasment. Try to find out this guy's address and then contact the police to have them file a complaint for harrassment and also for a restraining order. Good luck.
