Simple Assault in NJ

My brother's girlfriend's son assaulted my brother (punched him serveral times) my brother was thereafter arrested from simple assault (domestic violence). He told the police that he was arrested and was told to return the next day to provide a statement when he did and asked to file a complaint he was told that the person who files complaints had left and to return the next business day. Is this proper?

The bottom line is that he should speak to an attorney before doing anything. Anything he says could be used against him in the other case.
