Legal Question in DUI Law in New Jersey

i am a 18 yr old i have never been arrest or in any trouble .I got pulled over for a broken tail light. the officer looked inside my car n saw a brown bag under my seat , and ask to see the content of the bag i told them no. he precided to keep asking me can he search my car i told them no. so he told me to step out the car. after i stepped out the car he went under my seat and pulled out the bag . it contained alcohol. they gave me a ticket for M.I.P IN A MOTORVEHICLE. WHAT SHOULD I DO CAN I FIGHT THIS CASE. he did not have a warrant to search my car.

The answer to your question - "Can I fight this case" is, of course you can. You should hire an attorney to do so since that is your best chance of getting the best defense. However, you should know that a police officer who legally pulls a car over and sees something suspicious in plain view has the right to investigate further. He did in this case and found that you were doing something illegal. Now I am only making these observations based on the scanty information you have provided. I agree with Mr. Gleaner.

I think you would have a difficult time suppressing the brown bag, unless there are other circumstances that would come out in a consultation or investigation. You should definitely have an attorney with you and there is a possibility that there could be a downgrade or an amendment to the charges. Hopefully, you weren't disrespectful to the officer.
