Open Container in Northern New Jersey

couldn't find the category that what happened to me fit under. Anyway I got a ticket for open container. I was wondering what the typical court fees were for a municipal court in New Jersey? I've been told that this is a town ordinance ticket. I live in South Orange.

If you were charged with having an open container of alcohol in a motor vehicle, then this is a violation of the New Jersey statutes, 39:4-51b, and the penalties are a fine of $200.00 for a first offense and $250.00 plus 10 days community service for a second offense. If you are charged with having an open container of alcohol outside in public, and not in your car, then this probably is a local ordinance violation. You would have to contact the court or the town clerk to find out what the ordinance number is and what the penalties are. Usually however local ordinance violations result in a fine only. Well if its a town ordinance, then the fine is set by the town. It could be a big fine, but I doubt it. I would suggest calling up ahead of time and asking the court. If its just an ordinance and a small fine, you really don't need an attorney.

If this is a violation of 39:4:51b, fines for a first offense are: $200, plus court costs and a small surcharge. Fines for a second offense are: $250 (or 10 days community service), plus court costs and again the small surcharge. If this is a municipal ordinance offense you would need to check with the municipality for this information.
