Child support and dependency status

I am 23 and a full time college student. My parents are divorced and my father has paid child support since I was younger. An agreement in the divorce was that my dad gets to claim me on his taxes since he pays child support. Would this apply to me in the case that I provide over half of my own support and have not lived at home since I was 18. My dad pays 200/month to my mom and is also in arrears (He was on unemployment for most the year). My dad has provided no other support to me. Can I claim myself and If I do can he then sue my mom for the child support he paid? He told me I could not claim myself but I do not think that is fair. I made about $32,000 in 2008.

what you have described does not sound right, but you really need to talk to an accountant or maybe a divorce attorney who knows taxes to get advice.
