conflict of interest

what is considered a conflict of interest? If you have used this attorney to prepare a will, now your family is using him to sue you for custody of your children, is that a conflict?

Probably not as one issue has nothing to do with the other. I see where you are comming from but I've made this argument before and that's how I've seen judges come down on the issue.

He is in conflict of interest. He has confidential information about you as a result of having acted as your attorney and can not now sue you for a third party.
