Credit card debt responsibilities after being served.

After being served divorce papers is each spouse responsible for the other's credit card debt incurred after the date of being served. Wife is starting to rack up amounts on her credit cards now that she's been served. These cards are in her name only.

The date of the filing of the complaint for divorce is the cutoff date for marital assets and marital debts. Debt incurred after the date of the filing of the divorce complaint is solely the responsibility of the person incurring the debt.

These will be your wife's responsibility so long as the Court knows when the charges occurred. You should not go unrepresented because your wife can claim they are marital debts.
