Legal Question in Family Law in New Jersey

Dissolution of Marriage and Legal Separation

My ex-wife and I were legally seperated at Ft.Dix in september of 1991. Is there a statute of limitation allowing Divorce due to Spousal abandonment.

Re: Dissolution of Marriage and Legal Separation

In New Jersey, there is no status of "Legally Separated." A couple may be separated, but they are still married. In New Jersey once a couple has been separated for 18 months (no limit on how long beyond that) either or both may file for divorce based on that ground. Therefore, either of you, based on your facts, can file for divorce based on the ground of separation for 18 months or more. Good luck.
