Legal Question in Family Law in New Jersey

I have been divorced for 11 years. Am I still entitled to 1/2 of my ex-husbands pension? I had no lawyer when we divorced and when I did ask him for 1/2, his "team of lawyers" only offered me 1/3. Last I knew according to the laws of New Jersey, since I was married to him for more than 10 years, I am entitled to 1/2 of it. But I didn't know if it was too late to get it.

Hi,

It depends on what the Final Judgment of Divorce states. You also need to have a Qualified Domestic Relations Order (QDRO) filed with the pension administrator. I would recommend you take your FInal Judgment to an attorney to have them review it to see if you need to prepare a QDRO.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.
