How long for a divorce

I'm soldier station in Germany,My home of records in NJ,Can I file for my divorce in this state? This is where I got marrie,I have 3children and do I need a legal seperation before I can obtain my divorce? How long do I need to be seperatated? My husband is living in Virgina and is a permanet resident of that state.

You can file for divorce in either New Jersey or Virginia. New Jersey has a longer separation requirement than Virginia. I recommend that you speak with a legal assistance attorney at your JAG office. They can assist you by drafting a separation agreement, but they cannot file the divorce for you or get you a child support order from the court.

Your residence in New Jersey should be reflected by the address on your tax return; your New Jersey driver's license and your being registered to vote in New Jersey. If this is so, you can get divorced in New Jersey. It would be neater if you and your husband were able resolve all issues of the divorce by a written agreement, but you can get divorced without one.
