Real Estate and staying in the home

Hello,

I have two short questions.

1. My father in law and I purchased a home together for my wife and I to live in before we were married.

Is she entitled to any part of that house . She is not on the deed.

2. I have 2 children and I don't want to leave. My wife wants to go back to school at night while I support her for the next 2 years. As horrible as it is, I feel like I want to do this for the kids, to minimize the trauma before I'm forced to leave. Is this a good idea?

As to your first question, the answer may turn on whether your wife contributed to it or not. In fact, even if she did not, she may be entitled to some piece of the equity. For example, if she was the "stay-at-home" mom and you were the breadwinner, she may still be entitled to part of the equity. Your second question is very difficult to answer without a full picture as to all of your facts and circumstances. Keep in mind that this advice is given based on very limited facts. My advice may change based on other facts that may be given during a full interview. Further, no one can rely on advice given by an attorney who has not been retained.
