Legal Question in Family Law in New Jersey

Since I recently remarried and my new wife is employed, my ex-wife now believes she is entitled to additional alimony and child support. According to our divorce decree, she will receive alimony for 3 years. She is not working and has not attempted to look for employment. Does she have a case?

Your new wife has nothing to do with anything. I would have to review everything to see if she has a case. Of course, she doesn't have any type of case if she doesn't file a motion.

Child support and alimony is not based on the joint income of you and your new spouse, so I do not believe there is any merit to your ex-wife's claim. However, without having the full details of your case and reviewing your property settlement agreement, I cannot tell you definatively. Please contact my office to scheudle an appointment to review these items and further discuss this matter. Mention law Guru and we will waive any consultation fee. My telephone number is 732-663-1500.

Thank you.
