defamation defense

trial adjourned twice. allowed by judge. i am defendant. paid twice for expert to defend claim of plaintiff for intentional infliction of emotional distress. am now out $8,000. Judge continues to allow adjournments within 1 week of each trial. can I get new judge. also, has been 3 years since plaintiff's complaint filed against me.

I am not sure why you would have to pay for an expert not to attend the trial. Cases are frequently postponed. There may be other postponements. Ask your lawyer to alert the judge to the necessity to schedule arount the expert. I the alternative, arrange for trial on a certain date. The judge is not responsible for managing your side of the case. You and your lawyer are.
