If you are saying your insurance was not paid by the employer as then the employer breached a duty to you, and you should be able to hold the employer responsible. The best approach should be to tell them you will assume they made a mistake, and ask them to take responsibility for it, and correct it, whatever it takes. If that does not work, I would do first things first, and contact the insurance company, explain what happened, ask what you need to do to get insurance in place, and contact the hospital, explain everything to them, and tell them you will pursue the employer for their payment, and that you will need time, AND PUT EVERYTHING IN WRITING !!! If you have a conversation/phone call with anyone, document the call and what was said IN WRITING! Write down anything you think could possibly be important later NOW, and don;t talk with anyone from the company or hospital or insurance company, unless you have paper, and a pen in your hand, and DOCUMENT EVERYTHING! You may also need to retain an attorney.
