Legal Question in Immigration Law in New Jersey

illegal immigration

I have been married to a mexican for for 5 years. We file our taxes together with a tax payer id no. How do we go about getting legal papers for him. We have never applied for papers?

You should seek the advise of an immigration attorney to determine whether your husband is eligible to apply for benefits while in the US. The attorney will need to know your husband's immigration history, his family's immigration history as well as his criminal history (if any).

There is no easy answer that can be given to your question in this forum. In your husband's case a proper answer my depend on his age on arriving in the U.S. (e.g was he a child brought by his parents); was he here legally and overstayed; would it be best for him to return to his home country and apply for a visa through the U.S. Embassy in his home country? In summary, your husband should have an open and honest discussion with an immigration attorney. Remember, what ever your husband tells the attorney will be held in strict confidence. Best wishes.
