Legal Question in Immigration Law in New Jersey

Illegal Resident in USA for over 10 years.

Is there any possible ways for an illegal resident to stay in USA when she has been here for over 10years and has a daughter thats born here??

I have a aunt who was driving on a expired license and got taken away by the immigration people due to her illegal status.

I am seeking for someone who can help me or give me advice if there's anyway that I can bail her out??Also, is it possible to go visit her at all

Please HELP!!

Yes, your aunt MAY have options. What country is she from -- she may be eligible for a country specific benefit; how many U.S. citizen children does she have and what are their ages -- health status, etc. She may be eligible to claim hardship on her children if she is deported. There may be other possibilities, but you must sit down with a GOOD immigration lawyer who handles these type of cases. I suggest you search. Good luck.

Whether or not she has relief depends on a lot of factors, like whether she entered illegally or if she had an immigrant petition filed for her in the past.

In regards to bail and visitation at a criminal prison (as opposed to an immigration detention center), those two things should be available. You would have to contact the holding facility where she is being kept.

Dear Inquirer:

Your aunt should be placed in removal proceedings before an immigration judge. She will be eligible to apply for "Cancellation of Removal" as relief from removal. If she can establish that she has been here more than 10 years, has no significant criminal record and that her US Citizen daughter would suffer "exceptional and extremely unusual hardship," then the Judge may grant her a green card.
